Waiving Waivers – Is it Worth the Risk?

Every home business needs liability insurance. It’s a must-have. In Ontario, it is recommended that you strengthen your liability insurance with a customized commercial business plan or an industry-specific plan. These plans are offered in conjunction with liability insurance, and they offer an additional layer of protection to you, your business, and your valued clients.

Although liability insurance protects your business from claims against your business, the ultimate goal is to never have a claim. That’s where waivers come in.

What is a Waiver?

A waiver is a document that asks clients to waive certain rights. Waivers also usually list any risks, both common and unlikely. The client will be asked to also agree to the attestation that they have read and understand the risks associated with receiving lash extensions, and that they are willingly signing away their right to make a claim.

Waivers Protect Everybody

It can be tempting to waive the waivers. But waiving waivers can come at a huge cost to you, your business, your reputation, and your client’s wellbeing. Waivers are legal documents that protect you by showing that you’ve practiced due diligence. It proves that you made clients aware of risks before moving ahead with any procedures and that the client agreed to accept those risks. Waivers also protect clients by ensuring that they actually do understand the risks before they move forward with the lash extension application process. A waiver essentially transfers the risk from your business to the client.

A waiver is essential. InfinitiLash recommends having clients sign waivers before every procedure. Why?

• A client’s medical history or status may have changed, and the waiver will ask them to fill out a new medical questionnaire if this is the case

• The risks may have changed

• The client’s attitude toward risk may have changed

• It proves due diligence for every procedure you perform, in the case of an insurance claim

• It’s quick and easy, and it adds an extra layer of protection for everybody

• It lends credibility to your business and you as a professional

• Clients will see you as a true professional that cares about their health and wellbeing!

The Bottom Line

Waiving waivers isn’t worth the risk or potential cost to you, your business, or your reputation. You went into the lash extension business to make people feel beautiful, and the last thing you want to do is skip the waiver that is intended to keep them safe. When it comes to waiving waivers – don’t!
